These Terms and Conditions govern the use of the Vintage Cycles website and purchases made from Vintage Cycles.

1.1 About Vintage Cycles

Vintage Cycles is a Cape Town-based bicycle business specialising in the sale of pre-owned, vintage, refurbished and modern bicycles, as well as bicycle servicing, repairs, restoration and related products and accessories.

These Terms and Conditions govern the use of the Vintage Cycles website and purchases made through the website, by telephone, electronically or at our premises.

By using our website or purchasing products from Vintage Cycles, you agree to these Terms and Conditions, subject always to your rights under applicable South African law.

1.2 Product Descriptions

We make every reasonable effort to ensure that product descriptions, photographs, specifications, measurements, prices and availability displayed on the website are accurate.

However, photographs are provided for illustration and may not always show every minor cosmetic characteristic of an individual pre-owned or vintage bicycle.

Because many of our bicycles are pre-owned or vintage, individual bicycles may show reasonable signs of previous use, age and restoration, including minor scratches, paint imperfections, fading, patina or minor surface rust consistent with their age and character.

Such characteristics will not automatically constitute a defect where they have been disclosed or are reasonably apparent from the product’s age, condition and description.

Vintage Cycles does not represent pre-owned or vintage bicycles as brand-new bicycles.

1.3 Condition of Pre-Owned and Vintage Bicycles

Every bicycle is assessed according to its condition before sale.

Where applicable, bicycles may be serviced, repaired, restored or fitted with replacement components before being offered for sale.

A bicycle may contain a mixture of original, replacement, refurbished or newly fitted components.

Where a particular component has been replaced or upgraded, this may be stated in the product description.

1.4 Prices

All prices displayed on the website are in South African Rand (ZAR).

Vintage Cycles reserves the right to correct genuine pricing, typographical or product-description errors.

A price displayed incorrectly due to an obvious error does not oblige Vintage Cycles to supply a product at the erroneous price, subject to applicable law.

1.5 Orders

An online order constitutes a request to purchase a product.

An order is considered accepted once Vintage Cycles has confirmed the order and payment, subject to product availability and any applicable legal requirements.

If a product is unavailable after an order has been placed, Vintage Cycles will contact the customer and arrange an appropriate solution, including a refund where applicable.

1.6 Payment

Vintage Cycles may make various payment methods available from time to time, including electronic payments and approved online payment providers.

Payment must be received and successfully processed before an order is dispatched unless otherwise agreed in writing.

Where instalment payment options are offered, those transactions are subject to the terms and conditions of the relevant payment provider.

1.7 Bicycle Collection and Delivery

Customers may collect purchases from Vintage Cycles in Cape Town by prior arrangement.

Delivery is available for applicable products and destinations.

Delivery charges, delivery times and courier arrangements may vary according to the destination, size and weight of the bicycle or parcel and the delivery service used.

1.8 Risk During Delivery

Vintage Cycles will take reasonable care when packaging bicycles and products for delivery.

Where an independent courier is used, delivery will be subject to the courier’s operating procedures.

Customers should inspect a bicycle or parcel as soon as reasonably possible after delivery and notify Vintage Cycles promptly if there is visible transport damage.

This clause does not limit any statutory rights available to a consumer.

1.9 Warranty and Guarantee

Vintage Cycles provides a guarantee on bicycles subject to the applicable product terms and conditions.

Our pre-owned bicycles may have a specified guarantee period, while new bicycles may have different warranty arrangements depending on the product and manufacturer.

Nothing in this policy excludes or limits any statutory warranty or consumer right that cannot lawfully be excluded.

Normal wear and tear, damage caused by misuse, accidents, neglect, unauthorised modifications, incorrect maintenance or repairs carried out by an unauthorised person may not be covered by a voluntary Vintage Cycles guarantee.

1.10 Seven-Day Swap-Out

Vintage Cycles offers a seven-day swap-out facility, subject to the conditions of our Returns Policy.

The swap-out facility is intended to assist customers where a purchased bicycle is unsuitable, for example because of fit or suitability, subject to inspection and the conditions applicable to the bicycle.

A swap-out is not the same as an unconditional right to a cash refund.

Statutory rights relating to defective, unsafe or non-compliant goods remain unaffected.

1.11 No Buy-Back Facility

Vintage Cycles does not operate a general bicycle buy-back facility.

The return of a bicycle under a statutory right, warranty, approved return or seven-day swap-out does not create a general right for a customer to sell the bicycle back to Vintage Cycles.

1.12 Website Content

All reasonable care is taken to keep the website operational and information current.

Vintage Cycles does not guarantee that the website will always be available or free from technical errors.

Vintage Cycles reserves the right to update products, prices, specifications, photographs, services and website content from time to time.

1.13 Intellectual Property

The Vintage Cycles name, logo, photographs, graphics, written content and other original website material may not be reproduced, copied, modified or commercially used without written permission, except where permitted by law.

1.14 Limitation of Liability

Nothing in these Terms and Conditions excludes, restricts or limits any liability or consumer right that cannot legally be excluded or limited under South African law.

To the extent permitted by law, Vintage Cycles will not be responsible for losses caused by circumstances beyond its reasonable control.

1.15 Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.
